Welcome to CafeScraper (“the Platform”, “we”, “us”, or “our”).
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and CafeScraper regarding your access to and use of the Platform and related services, including but not limited to the website, APIs, cloud execution environment, and other associated services.

Acceptance of the Terms

  • Before registering for or using the Services, please carefully read and fully understand these Terms;
  • Pay special attention to clauses related to limitation of liability, risk allocation, and intellectual property;
  • If you do not agree to any part of these Terms, you must immediately stop registering for or using the Services.

User Conduct

  • You agree to comply with all applicable laws and regulations and shall not upload or execute any illegal, infringing, or non-compliant content or scripts;
  • You are responsible for safeguarding your account credentials and preventing unauthorized access or use.

Service Availability and Limitations

  • The Services are provided on an “as-is” and “as-available” basis and may be subject to unforeseen interruptions or failures;
  • To the maximum extent permitted by law, the Platform shall not be liable for losses caused by service interruptions, network issues, or third-party factors.

Modification of the Terms

  • We reserve the right to modify these Terms when necessary and will notify users via announcements, email, or platform messages;
  • Updated Terms become effective upon publication or notice. Continued use of the Services constitutes acceptance of the revised Terms.

1. Definitions

  1. “Platform” means the website operated by CafeScraper (www.cafescraper.com or its subdomains), client applications, and related cloud-based technical services.
  2. “User” means any individual or entity that registers, accesses, or uses the Platform, including:
    • “Developer”: a User who uploads, publishes, sells, or licenses scraping scripts on the Platform;
    • “Consumer”: a User who purchases, rents, or runs scripts provided by Developers to obtain data.
  3. “Script” means computer code uploaded by a Developer (typically web crawlers or data extraction programs) used to automatically access online resources and extract or process data.
  4. “Content” includes but is not limited to Scripts, script descriptions, documentation, user profiles, comments, and data outputs generated by running Scripts.
  5. “Services” refer to all features provided by the Platform, including the script marketplace, cloud execution environment, data storage, payment processing, and community features.

2. Account Registration and Eligibility

  1. By registering, you confirm that you are a natural person, legal entity, or organization with full civil capacity. If you are under 18 years old, you must review and accept these Terms under the supervision of a legal guardian.
  2. You must provide true, accurate, complete, and up-to-date registration information and promptly update such information as necessary. You are solely responsible for any consequences arising from inaccurate or incomplete information.
  3. You are responsible for maintaining the confidentiality of your account credentials and are fully liable for all activities conducted under your account. You must notify us immediately of any unauthorized use.
  4. CafeScraper does not currently require mandatory real-name verification, but reserves the right to introduce identity verification measures in the future as required by law or business risk control.

3. Services and Usage Rules

3.1 Script Review and Listing

  1. All Scripts uploaded by Developers must pass a prior manual review before being listed on the marketplace.
  2. Review principles include but are not limited to:
    • Legality: Scripts and their intended use must comply with all applicable laws and regulations;
    • **Respect for **robots.txt: Scripts must comply with the target website’s robots.txt rules and must not scrape prohibited content;
    • Reasonable Access Frequency: Scripts must implement reasonable delays and concurrency limits to avoid excessive server load or denial-of-service risks;
    • Prohibited Categories: Scripts designed to scrape the following data are strictly prohibited unless the Developer can provide proof of proper authorization:
      • Financial data requiring special regulatory approval (e.g., real-time stock trading data, non-public financial reports);
      • High-precision mapping or geolocation data requiring surveying licenses;
      • Full-text copyrighted news content, subject to licensing and quantity restrictions.
  3. Platform review is a preliminary and formal review only and does not guarantee long-term validity, absolute legality, or suitability for specific websites. Approval does not constitute endorsement by the Platform.

3.2 Intellectual Property

  1. Developers retain all original intellectual property rights, including copyrights, to the Scripts they upload.
  2. Developers grant CafeScraper a worldwide, royalty-free, irrevocable license to use, store, display, distribute, run, reproduce, and modify the Scripts solely for the purpose of providing the Services.
  3. Output data generated by running a Script belongs to the Consumer who runs the Script, provided such data does not infringe upon any third-party rights (including copyrights or database rights).

3.3 User Conduct

You represent and warrant that you will:
  1. Comply with all applicable laws, regulations, and legally binding rules.
  2. Not engage in any illegal, infringing, disruptive, or harmful activities, including but not limited to:
    • Uploading Scripts containing malware, viruses, or malicious code;
    • Attempting to bypass platform security or review mechanisms;
    • Disrupting or damaging the Platform or connected servers or networks;
    • Engaging in fraudulent transactions or money laundering;
    • Infringing intellectual property, trade secrets, privacy, or reputation rights.
  3. As a Consumer, you acknowledge and agree that:
    • You are solely responsible for the Scripts you choose to run, their targets, parameters, and the resulting data;
    • You must independently ensure that your data collection and use comply with target website terms, robots.txt, and applicable laws (including Cybersecurity Law, Data Security Law, Personal Information Protection Law, GDPR, etc.);
    • You are the “data controller” of the output data as described in Section 3.2 and bear all legal consequences arising therefrom.

4. Liability and Risk Allocation (Important)

  1. Platform Role: CafeScraper is a neutral technology platform and infrastructure provider. We provide a marketplace and execution environment but do not create, control, or substantively review Scripts, do not control what data Users scrape, do not own scraped data, and do not participate in Users’ use of such data.
  2. Disclaimer:
    • No Warranties: Services are provided “as is” and “as available.” CafeScraper expressly disclaims all warranties, including fitness for a particular purpose, accuracy, reliability, security, continuity, or non-infringement.
    • Script Risks: We make no guarantees regarding Script functionality, error-free operation, or continued availability. Scripts may fail due to website changes or anti-scraping measures.
    • Indemnification: Any claims, losses, liabilities, damages, or expenses (including attorney’s fees) arising from a User’s violation of laws, these Terms, or third-party rights shall be borne solely by that User. Users shall indemnify and hold CafeScraper harmless.
    • Indirect Damages: CafeScraper shall not be liable for any indirect, consequential, incidental, punitive, or special damages, including loss of profits, data, goodwill, or business interruption.
  3. Limitation of Liability: To the maximum extent permitted by law, CafeScraper’s total liability for direct damages shall not exceed the total service fees paid by you to CafeScraper in the twelve (12) months preceding the event giving rise to the claim.

5. Violations and Enforcement

If a User is found to violate laws, these Terms, or public order and morals, CafeScraper may take one or more of the following actions:
  1. Warning;
  2. Removal of violating content (e.g., delisting Scripts);
  3. Restriction or suspension of Services;
  4. Freezing related funds or commissions;
  5. Account suspension;
  6. Permanent account termination;
  7. Public disclosure of violations;
  8. Reporting to authorities;
  9. Legal action.

6. Service Modification, Suspension, and Termination

  1. We may modify, suspend, or terminate any part of the Services as necessary.
  2. If you do not agree with modifications, you should stop using the Services. Continued use constitutes acceptance.
  3. You may close your account via Platform features. Upon account closure, personal data will be handled in accordance with applicable laws and our Privacy Policy.

7. Privacy

Your personal data is handled in accordance with the separately published CafeScraper Privacy Policy.

8. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of Mainland China, excluding conflict-of-law principles.
  2. Any dispute arising from these Terms or the Services shall first be resolved through friendly negotiation. Failing that, either party may submit the dispute to the People’s Court with jurisdiction over the location of CafeScraper’s operating entity.

9. Miscellaneous

  1. These Terms constitute the entire agreement between you and CafeScraper regarding the Services.
  2. Failure to enforce any right does not constitute a waiver.
  3. If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force.
  4. You may not assign your rights or obligations under these Terms without prior written consent.
